Terms of Service

Rules for ordering and using Hostung VPS, dedicated servers, domains and infrastructure services.

Document status and acceptance

These Terms govern the use of the website, customer account and Hostung hosting services, including VPS, dedicated servers, domains and related infrastructure services.

The service provider is the Hostung administration, available at hostung@hostung.net and via Telegram @HostungSupport. A user is a legally capable individual, sole trader or organization that places an order.

Creating an account, paying an invoice or using a service constitutes acceptance of the current Terms. Anyone ordering on behalf of an organization confirms that they have the required authority.

Service description

  • The scope, resources, location, billing period and price are defined by the selected plan and the order in the customer account.
  • VPS and dedicated servers are unmanaged unless a plan expressly states otherwise. The user is responsible for operating-system, application and access configuration.
  • Hostung does not keep logs of user-traffic content or activity inside a VPS. Technical, account and payment data is processed only as required to provide and protect the service.
  • Domain services are subject to the rules of the relevant registry and registrar. Registration is not guaranteed until confirmed by the registry.

Account and security

Users must provide accurate information, keep it current and protect passwords, API keys, SSH keys and other credentials.

Actions performed after successful authentication are treated as the user's actions until Hostung is notified of compromise. Suspected unauthorized access must be reported immediately.

An account may not be transferred to a person who cannot lawfully receive the services, and restrictions, security checks or a prior suspension may not be bypassed.

Orders, activation and changes

An order is accepted after payment is confirmed and the service is technically available. VPS activation usually takes a few minutes; dedicated servers and certain domain operations may take longer.

Hostung may reasonably verify an order where fraud, sanctions or security risks are indicated. Activation may be paused until verification is complete.

Plan, location, IP-address or configuration changes depend on technical availability and may interrupt service. Material consequences are disclosed before confirmation.

Payment, renewal and refunds

  • Prices and currency are shown in the customer account. Taxes and fees may be added where required by law or the selected payment method.
  • Services are prepaid. The user is responsible for renewal unless automatic renewal is explicitly enabled.
  • After a missed payment, Hostung may suspend the service and, after a reasonable period, delete data and release resources. The available renewal or export period is shown in the account or notice and may depend on the service and supplier.
  • Refund requests are reviewed with regard to service already provided, non-refundable costs incurred and mandatory consumer rights. Domains, licences, dedicated IP addresses and custom-prepared resources are normally non-refundable after fulfilment.
  • Unless a separate refund guarantee is published for the plan, each request is assessed individually based on activation time, actual resource use, Hostung's costs and mandatory rights under applicable law.

Acceptable use

Users must comply with applicable law and third-party rights. Services may not be used for:

  • malware, botnets, phishing, credential theft, fraud or bypassing security systems;
  • DDoS attacks, unauthorized scanning, intrusion, traffic interception or control of compromised systems;
  • spam, bulk unsolicited messages or sender impersonation;
  • child sexual abuse material, human exploitation, terrorist activity or direct threats;
  • infringement of copyright, trademarks or other rights where supported by sufficient evidence and applicable law;
  • activity that creates a material risk for the Hostung network, its suppliers or other users.

Complaints and service restrictions

Hostung reviews complaints manually and considers their legal basis, supporting materials and infrastructure risk. Users are generally given a reasonable period to respond or remedy a violation.

Immediate restriction is permitted for an ongoing attack, malicious activity, a threat to life or security, manifestly unlawful content, a sanctions prohibition or a binding order from a competent authority.

Measures should be proportionate to the risk and may include port or IP restriction, temporary isolation, service suspension or account termination.

Resources, backups and data

Users must not systematically exceed purchased resources or interfere with other customers. In case of abnormal load, Hostung may temporarily limit a resource and offer another plan.

Unless backup service is listed separately in the plan, users are responsible for creating and testing external backups. Any technical copy held by Hostung is not a restoration guarantee.

After termination, data is deleted following the stated retention period and may become unrecoverable. Users must export their data before termination or expiry.

Availability and maintenance

Hostung aims to maintain the stated availability level but does not guarantee uninterrupted operation. SLA metrics and credits apply only where separately published for a plan.

Planned maintenance is announced in advance where possible. Emergency maintenance may be carried out without prior notice where delay would increase risk to the network or data.

Hostung is not responsible for external networks, domain registries, user actions, user software, DDoS traffic beyond the connected protection profile or events outside reasonable control.

Liability

Each party is responsible for direct proven loss caused by its breach to the extent permitted by applicable law. Nothing limits liability that cannot legally be limited.

Unless mandatory rules require otherwise, Hostung's aggregate liability for a specific service is limited to the amount paid for that service during the previous three months. Hostung is not liable for indirect loss, lost profit or data loss that could have been prevented through backups.

The user will reimburse reasonable loss caused by unlawful use of the service or infringement of third-party rights, provided the user is notified and allowed to participate in the defence.

Term, termination and amendments

These Terms apply from acceptance until account closure and completion of outstanding obligations. A user may cancel through the customer account, subject to the paid period and refund rules.

Hostung may terminate a service for a material or repeated breach, unpaid debt, legal prohibition or inability to continue providing it. Where permitted, the user is notified and given an opportunity to export data.

New revisions are published on this page. Material changes are announced in advance through the website or customer account; continued use after the effective date constitutes acceptance unless separate consent is required by law.

Applicable law and contacts

The relationship is subject to mandatory legal rules that cannot be excluded by agreement. The parties will first seek to resolve disputes through a written claim and negotiation; unresolved disputes are referred to the competent court determined under applicable conflict-of-law and procedural rules.

Service questions may be submitted through the customer account or Telegram @HostungSupport. Legal notices, data requests and abuse reports are accepted at hostung@hostung.net. A report should include the sender's contact details, the affected IP address or domain, a description and supporting materials.
